Within the teaching activities of the Jean Monnet Module DERECHO – Defense of European Rights and Excellence for Consumers HarmonizatiOn, students participated in a Student Talk dedicated to the analysis of unfair terms in consumer contracts, within the framework of Directive 93/13/EEC.
Prior to the session, students received initial theoretical training to enable them to tackle the activity. Thanks to this foundation, they were able to choose from various typologies of unfair terms and prepare the session. The students presented different typologies of these terms, doing so in two ways: on the one hand, demonstrating technical-legal explanatory capacity; and on the other, adopting an approach and tone suitable for outreach and dissemination to society. Furthermore, they explained real cases and practical examples, applying European Union Law principles against contractual practices contrary to the requirements of good faith, which cause a significant imbalance in the parties’ rights and obligations arising under the contract, to the detriment of the consumer.
This dynamic is part of the project’s methodological approach, which promotes active learning and critical reflection through student presentations, fostering their legal argumentation skills and familiarity with European jurisprudence (case law).
The Jean Monnet Module DERECHO thus seeks to train a new generation of jurists capable of interpreting and applying Union Law from a perspective that is rigorous in theoretical and technical-legal terms, yet practical, and endowed with the necessary social and civic sensitivity.
